By using our product / services, you consent to our use of your data as stated here in this privacy policy. The policy applies to our clients, visitors to the IPCalculus’ website, web applications, blog pages, and any other service we provide. Your rights over your personal data are set out in Section 8 – Your Rights and Choices.

IPCalculus reserves the right to revise, amend, or modify this Privacy Policy at any time and in any manner. However, if IPCalculus plans to materially change how it plans to use previously collected personal information, IPCalculus will provide you with advance notice prior to the change becoming effective and an opportunity to opt-out of such differing uses. 3. Personal data collected
We receive your personal data in three different ways:
I. Data that you provide to us:
We collect personal data directly from you, for example, the contact information and log-in credentials that we use to provide our services to you.
II. Data about you that we obtain elsewhere:
IPCalculus provide intellectual property consulting services to companies, law-firms, universities, individual inventors and patent professionals. If you are, for example, an academic researcher, a patent holder, IPR attorney or IPR professional, your professional data may be publically available. We collect this professional data from publicly available sources like academic publications, patent offices, regulatory agencies and other web sources. We acquire marketing lists from third parties to identify prospects for our services (see Section 8 – Your Rights and Choices for information on managing your marketing preferences).
III. Data that we collect via standard online technologies:
Like most websites and web-based products, our services use standard technologies, like web server logs and cookies, to collect information about our visitors and end-users. Some of our services allow you to register or log in via social media credentials. If you choose this option, the personal data that we collect will depend on the privacy settings of your social media account.
Sensitive personal data
We do not process personal data about race or ethnicity; political opinions, or religious or philosophical beliefs; trade union membership; or genetic, biometric, health, or sex-life information (“special categories of personal data” as defined by the European Union General Data Protection Regulation) unless you provide or indicate such information in a user-controlled area of our services, for example a professional profile.
Google invisible reCAPTCHA
We sometimes use Google Invisible reCAPTCHA to secure our products and websites from abuse. Invisible reCAPTCHA collects hardware, software, and user interaction data from your device for risk analysis. reCAPTCHA data collection and use are governed by the Google Privacy Policy.
Third-party websites
Our services may contain links to third-party websites. We are not responsible for the privacy practices of those sites.
4. Purposes of processing
For individuals in the European Economic Area (EEA) or Switzerland, pursuant to Article 6 of the EU General Data Protection Regulation (GDPR), our collection and processing of your personal data is based on lawful processing. Lawful basis for data processing includes explicit consent that you have provided us, and/or through contract with you (for example to carry out any contractual obligation that we may have entered with you), and/or for legitimate business interests that include providing you with our products and services.
Any consent that you provide can be revoked by you at any time. However, where legitimate business interests are concerned, you have the right to object to data collection and processing in which case we reserve the right to delete your account to comply with your objection to having your data stored and processed. 5. Recipients of the data
Your personal data will, depending on the purposes of processing, be disclosed to different individuals and organizations, including:
· IPCalculus employees and contractors whose roles require access to your data. Our personnel are bound to confidentiality terms which cover their obligations to protect personal data.
· IPCalculus suppliers who process personal data on our behalf (“processors”); for example Cloud computing providers and web analytics services like Google Analytics. Such vendors are contractually bound to protect your data to the same standard as set out in this Notice.
· Your data may be transferred to a third party as a result of any merger, acquisition, or similar corporate event involving IPCalculus.
· We will disclose your personal data when required to by law.
6. Data security
IPCalculus maintains appropriate administrative, technical, and physical security measures to protect your personal data from accidental loss and unauthorized access or use. These measures include encryption, firewalls, roles-based data access, intrusion-detection software, and physical access controls to data centers.
7. Data retention
We store your personal data throughout the period of your relationship with us, and retain it for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying legal, accounting, or reporting obligations or to resolve disputes. 8. Your rights and choices
Individuals in the European Economic Area have the following data protection rights:
The right to withdraw consent. You have the right to withdraw your consent to the processing of personal data collected on the basis of your consent at any time. Your withdrawal of consent will not affect the lawfulness of IPCalculus’ processing based on consent before your withdrawal.
The right of access to and rectification of your personal data. You have a right to request that we provide you a copy of your personal data held by us. You may also request us to rectify or update any of your personal data held by IPCalculus that is inaccurate. Note that your rights to personal data are not absolute. Access may be denied when:
· Denial of access is required or authorized by law;
· Granting access would have a negative impact on other’s privacy;
· To protect our rights and properties; and
· Where the request is frivolous or vexatious.
Right to erasure. You have the right to request erasure of your personal data that: (a) is no longer necessary in relation to the purposes for which it was collected or otherwise processed; (b) was collected in relation to processing that you previously consented, but later withdrew such consent; or (c) was collected in relation to processing activities to which you object, and there are no overriding legitimate grounds for our processing.
Right to restriction of processing . You have the right to restrict or object to us processing your personal data where one of the following applies:
· You contest the accuracy of your personal data that we processed. In such instances, we will restrict processing during the period necessary for us to verify the accuracy of your personal data.
· The processing is unlawful and you oppose the erasure of your personal data and request the restriction of its use instead.
· We no longer need your personal data for the purposes of the processing, but it is required by you to establish, exercise or defend legal claims.
· You have objected to processing, pending the verification whether the legitimate grounds of IPCalculus’s processing override your rights.
Right to data portability. If we process your personal data based on a contract with you or based on your consent, or the processing is carried out by automated means, you may request to receive your personal data in a structured, commonly used and machine-readable format, and to have us transfer your personal data directly to another organization, where technically feasible, unless exercise of this right adversely affects the rights and freedoms of others.
Right to object. Where the processing of your personal data is based on consent, contract or legitimate interests you may restrict or object, at any time, to the processing of your personal data as permitted by applicable law. We can continue to process your personal data if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.
Automated individual decision-making, including profiling . You have the right not to be subject to a decision based solely on automated processing of your personal data, including profiling, which produces legal or similarly significant effects on you, save for the exceptions applicable under relevant data protection laws. IPCalculus will inform you should automated individual decision-making, including profiling, take place.
Right to lodge a complaint. If you believe that we have infringed your rights, we encourage you to contact us first at data.privacy@ipcalculus.com so that we can try to resolve the issue. However, you have the right to lodge a complaint with a supervisory authority in a member state of your habitual residence, place of work, or place of alleged infringement.
Notification of erasure, rectification and restriction . We will communicate any rectification or erasure of your personal data or restriction of processing to each recipient to whom your personal data have been disclosed, unless this proves impossible or involves disproportionate effort.
Marketing : We would like to send you marketing communications, for example event invitations, white papers and information about our services that may interest you. We will obtain your prior consent when your local law requires it.
